Responding to a Notice of Intent to Reduce, Discontinue, or Deny Benefits
By Requesting a
FAIR HEARING


If you receive a notice telling you that your benefits will be reduced or discontinued, and if you disagree with the reason for this action, ask for a Fair Hearing immediately. You should do this before the "effective date" on the notice. If you ask for the fair hearing within this time period, your center must continue your benefits unchanged until you receive a fair hearing decision. If your center does not continue your benefits unchanged, get legal assistance by calling WE CAN at 718-487-2300.

Important Note: If your welfare center reduces or discontinues your benefits without first notifying you of its intention to do so, immediately request a fair hearing. The center may be forced to restore your benefits before you receive a fair hearing decision under these circumstances, as well.

 

HOW TO REQUEST A FAIR HEARING:
